Growthfuel Terms
The relationships between you, the user, and Growthfuel are outlined in the terms that follow. Please be informed that all website users are subject to these Terms. The Terms may from time to time be amended and modified to reflect changes in corporate policy. You automatically accept the revised Terms by using the website after these changes have been made.
User Registration
To use the Growthfuel services, you must complete the website registration process. A required step in the registration procedure is choosing a password. You hereby agree not to register or use any other person’s name, real or made-up, during the registration procedure on any of our websites other than your own. The confidentiality of their passwords and any unauthorized access to their accounts on our websites are the responsibility of the users. Services
The services outlined in the Pricing Policy will be offered by Growthfuel in the manner specified. It is possible that the needed work’s scope will vary as the assignment progresses. Where this is the case, Growthfuel will make every effort to communicate with you about it as soon as possible to come to an agreement on any modifications to the scope of the Services that may be required.
Information
We must collaborate with you as a team in order to maximize Growthfuel’s effectiveness. The success of Growthfuel’s work frequently depends on your (or your other advisers’) fast information delivery. Growthfuel will assume all information you provide is complete and accurate unless you inform us otherwise in order to avoid needless verification.
Links and Sharing
Users are encouraged to freely share details about our website. Users are welcome to spread information about Growthfuel and its services so long as it does not imply that we are endorsing or sponsoring outside sources. No copyrighted items may be used without the owner’s prior written consent.
Payment Terms
Unless otherwise agreed, invoices must be paid by bank transfer into Growthfuel’s designated bank account within 14 days of the invoice’s date. Up until full payment has been received, Growthfuel retains ownership of all work.
Refund Policy
Users have the right to ask for a refund if they are unhappy with or disappointed in the quality of the Growthfuel services they received. However, a refund is only possible if the following prerequisites are satisfied:
- the deadline for providing a service has been delayed for two whole weeks against the estimated schedule;
- the user has previously submitted all the information required to fulfill the project successfully, such as technical specifications, a detailed description of services needed, and such;
- a refund was requested by contacting Growthfuel via email at [email protected].
Other Specialist Services
Unless otherwise stated in the estimate, Growthfuel’s assessment is exclusive of third-party costs such as photography, artwork, video production, sound recording, etc. Unless you direct us otherwise, Growthfuel may seek out such specialized services in fields beyond our area of expertise. The price of such services will be quoted in accordance with and passed through to.
Scoping
Growthfuel typically gives clients a scoping document that describes the functionality of the work we undertake for them, including but not limited to marketing services. Any modifications that go beyond the scope will be treated as a new update and charged accordingly when the customer signs and authorizes this scoping document.
Content
It is your responsibility to give us the necessary details regarding your company’s marketing and commercial goals. Growthfuel disclaims liability for any inaccuracies in content that you submit. Any resulting adjustments can be subject to regular rates of charge. It is your obligation to supply all necessary text and graphic assets that make up the work’s content, unless otherwise stated. Except as expressly specified in advance, all content must be provided in an appropriate digital format.
You authorize Growthfuel to use your company’s logos and other identifying marks in developing the project. You consent to defend Growthfuel against any legal action brought because of your carelessness or failure to secure the necessary copyright authorizations for all supplied content.
Confidentiality
Growthfuel will always maintain the privacy of your data and business dealings, save as required by law, unless you authorize publication or the pertinent facts are already known to the public. However, Growthfuel has the right to reveal your data and affairs to:
- such of your other service providers as you inform Growthfuel are involved in any assignment on which Growthfuel is instructed;
- Growthfuel’s affiliates or related parties; and
- any other service provider to whom Growthfuel may properly delegate aspects of any assignment in order to provide a full range of services to you.
Intellectual Property
Freedom to use Ideas and IP
Any ideas, concepts, source code, information, or know-how contained in any materials delivered to you (in whatever form) or otherwise developed during the course of providing services to you may be set by Growthfuel or used for other clients.
Ownership of Materials and Intellectual Property
After you have paid Growthfuel in full for the relevant materials, all products, creative works, plans for designs, original campaign ideas, slogans, copy themes, preliminary sketches, layouts, copy, artwork, production services, public, and other marketing materials (whether on paper, computer disk, by email, or in some other digital format) will be your property, with the exception of any intellectual property rights therein that have been reserved by Growthfuel or third parties engaged or employed by Growthfuel.
Portfolio Rights
For the sole purpose of marketing our work, Growthfuel retains the right to feature your project on their website and design portfolio.
Indemnity
Only legal uses are permitted for all services. You consent to defend Growthfuel and hold us free from any claims that your use of our service has harmed you or another person.
Liability
Our total liability to you in contract or in tort arising in connection with this contract shall not exceed the total price paid by you. We shall have no liability for loss of profits, business, revenue, goodwill or anticipated savings or for any other indirect or consequential loss.
Termination and Force Majeure
If you decide to end the agreement after the work has begun, you will be charged for the work that has already been done.
When a delay in performance or inability to fulfill an obligation results from events outside Growthfuel’s reasonable control, Growthfuel shall not be held responsible.
Variation
By written agreement between us, these Terms and Conditions (and/or the provisions of any agreement to which they pertain) may be modified or replaced at any time. Unless otherwise expressly agreed, such such modification shall not impact any rights or obligations of either of us that may have already accrued.
